1. General information

The following general terms and conditions (the "Terms and Conditions") apply to all orders made by the customer (hereinafter referred to as "you") of products via www.simrig.se through SIMRIG's website.

In order to make a purchase on SIMRIG's website you must accept the Terms and Conditions. By accepting the Terms and Conditions, you agree to abide by the Terms and Conditions in full and agree that you have read the information about personal data.

References in the Terms and Conditions to "SIMRIG" or "we" are to SIMRIG AB, org. no. 559172-3936. The company is based in Lindome. The company's address is Torkelsbohögsvägen 11.

2. Order

In order to make a purchase on SIMRIG's website you must be 18 years or older.

An order confirmation will be sent to your email address when you complete an order. The purchase contract is made when we confirm the order through an order confirmation. In the confirmation you will find all information about products, price, billing, and delivery address.

3. Delivery

If delays should occur (without us notifying you of longer delivery time) you should contact us by email: .

If your package arrives at a pick up point a notification will be sent to you by email or SMS. As customer you are responsible for ensuring that the entered phone number, address, and e-mail address are correct. If you do not pick up your package you will be charged for the return.

4. Prices

All prices on the website are stated in EUR and include VAT.

The total cost of the purchase will be evident before placing the order and will include all costs associated with the purchase including postage and shipping costs.

We reserve the right to adjust the price of our products at any time. However, if you have ordered but not yet paid for a product, we guarantee the price for one month form when the order was placed.

5. Payment options

We use PayPal for secure payments. They accept credit and debit cards among other things.

6. Withdrawal

When purchasing goods on the website, you as a customer have a legal fourteen days right of withdrawal that applies from the time you have received a product that you have ordered.

6.1 When using your right of withdrawal

You must notify that you withdraw the purchase by sending an email message to . In the message, your name, address, email address, order number, and which goods the return applies to must be clearly stated.

You should return the products to us immediately and at the latest within the legal fourteen days after the notice of withdrawal.

You are responsible for return shipping, delivery and condition of the products when returning. The products should therefore be sent well packaged and in original packaging.

On the refund amount, we reserve the right to deduct a sum corresponding to the decrease in value compared to the original value of the product when used or damaged.

6.2 The right of withdrawal does not apply to

Tailor made products which has been specially tailored for you or has a clear personal touch as of your wishes.

Services that have been completed and where you have explicitly consented to the service commencing without a right of withdrawal.

7. Warranty

We warrant that the products shall be delivered free from defects in material and workmanship and in accordance with mutually agreed specification.

The warranty for products shall expire one year from the shipment date of the products. After the expiration of this first year we shall no longer accept warranty claims and all obligations for warranty shall terminate. The warranty shall expire if the product is resold.

If the product do not meet the above warranties, we shall repair or replace the defective product, exclusively when you notify SIMRIG through in a maximum of thirty days after having noticed the defect. Warranty repair or replacement shall not extend or renew the warranty period.

The warranty does not cover products stored, installed, used or cared for improperly. Neither if it is due to normal wear and tear, damage caused by blows or accidents, voltage failure after failure caused by nature, such as lightning strikes etc., or if the product is placed outdoors or in a damp environment.

You must always contact us for approval before returning a defective item.

The warranty does not cover commercial use. It only covers personal use.

7.1 How to proceed with warranty cases

Any errors and defects must always be notified to with specification of your name, address, e-mail address, order number, and a description of the error.

You should return the products to us after receiving approval; at the latest within thirty days after the approval is given.

You are responsible for return shipping and delivery unless otherwise agreed in your specific case. The products should therefore be sent well packaged and in original packaging if possible.

If we fail to repair the product or deliver a similar product, we will refund you for the defective product in accordance with applicable consumer protection legislation.

We reserve the right to refuse a warranty case if it turns out that the product is not faulty or if the deadline for returning the product is exceeded. For warranty cases we follow guidelines from the Swedish General Complaints Board (ARN).

8. Limitation of liability

We take no responsibility for indirect damages that may occur due to the product.

We do not accept any liability for delays/errors due to circumstances beyond the company's control (Force Majeure). These circumstances can be, for example, labor conflict, fire, war, authority decision, reduced, or no delivery from supplier.

Furthermore, we take no responsibility for any changes to products/product characteristics that have been changed by the respective supplier and other factors beyond our control.

9. Product information

We reserve the right for any printing errors on this website as well as final sales of products. We do not guarantee that the images reflect the exact appearance of the products, as a certain difference in color may occur depending on the display, photo quality and resolution. We always make our best effort to show the products as accurately as possible.

10. Information about Cookies

According to the law on electronic information, visitors to a website must, for the sake of privacy, be informed about the use of cookies. By shopping at SIMRIG AB you accept our data protection policy and our processing of your personal data. We safeguard your personal privacy and do not collect more information than necessary to process your order. We never sell or pass on your information to third parties without legal basis.

SIMRIG AB is responsible for the processing of personal data that you provided to us as a customer. Your personal information is processed by us to handle your order and in the occasions when you have wanted newsletters or promotional offers - to be able to adapt the marketing to your individual needs.

Below is a summary of how we, in accordance with the Data Protection Regulation (GDPR), store and process your data.

A personal information is any information that can be directly or indirectly attributed to a physical person.

11.2 What information do we store?

To handle your order and answer questions related to your order (customer service) we store your first name and surname, address, phone number, e-mail address, IP address and purchase history.

Your information is stored as long as we have a legal basis to process your information, for example to fulfill the agreement between us or to comply with a legal obligation under the Accounting Act, for example.

In connection with a purchase, your personal data is processed to complete the agreement with you. Marketing, promotions and similar mailings are made after your consent.

11.4 What information is shared and for what purpose?

11.4.1 Payment provider

When making purchases, information is shared with our payment provider. What is stored is the first name, last name, address, e-mail address and telephone number. The information is saved in order to carry out the purchase and to protect the parties against fraud.

The payment providers (payment services) that we use are: PayPal.

11.4.2 Freight companies

In order to deliver your orders and complete our agreement, we must share specific information with the shipping company. What is shared with the shipping company is first name, surname and address information for delivery. E-mail address and/or mobile number may also be shared with the shipping company for notification. The shipping companies we work with are: PostNord, DHL and UPS.

11.4.3 Newsletter

If you have chosen to subscribe to our newsletter, first name, last name and email address will be shared with our newsletter supplier. This is to keep you updated with information and offers for marketing purposes.

We use MailChimp to send out newsletters.

11.5 The right to access

You have the right to get extracts of all the information that is about you from us and will, upon request be delivered electronically in a readable format.

11.6 Right to correction

You have the right to ask us to update incorrect information or to supplement information that is defective.

11.7 The right to be forgotten

You may at any time request that the information relating to you be deleted. There are few exceptions to the right to deletion, such as if it is to be retained because we have to fulfill a legal obligation (for example, according to the Accounting Act).

SIMRIG AB is responsible for storing and processing personal data in the online store and ensuring that the rules are followed.

We reserve the right to make changes to the terms and conditions at any time. Changes to the terms will be published online on the website. The amended terms and conditions are deemed to be accepted in connection with orders or visits to the website.

13. Dispute and choice of law

In the event that a dispute cannot be resolved in agreement between the SIMRIG and the customer, you, as a customer, can contact the Swedish General Complaints Board (ARN). For residents of another EU country than Sweden, complaints can be submitted online via the EU Commission's platform for mediation in disputes.

In the event of a dispute, we follow decisions from ARN or the corresponding dispute resolution body.

Disputes concerning the interpretation or application of these general terms and conditions shall be interpreted in accordance with Swedish law.

14. Force Majeure

We shall not be liable or considered in breach of our obligations when delays of agreements/commitments are caused by the event of war, natural disaster, labor market action, government decisions and comparable events beyond our control that could not reasonably be foreseen.
